Is it legal to take a phone from a minor, that the minor is paying for?

You don't have the right to sue and be sued until you're 18. You can, however, start working and saving money so you can move out on the day you're 18. Then you can pay rent, utilities, pay for all your food, buy a car and make car payments, pay for gas, repairs, insurance, pay for all of your own clothes, pay your own phone bills, internet, pay for college or trade school tuition and books, pay for your own vacations, etc. Most parents let their children have a savings account solely in their name before they're 18. If you don't have one, tell your parents you want one so you can move out on the day you turn 18. That'll motivate them. You'll need about $2,000.00 up front for a half-decent apartment.
